Legal Politics of the MPR's Existence of its Legal Products in the Hierarchy of Legislation Number 12 of 2011 concerning the Formation of Legislation

Undang-Undang Number 12 Tahun 2011 on the Establishment of Laws and Regulations has reinserted the MPR Decree into laws and regulations. After the Constitution was amended, the MPR's authority to issue TAPs that regulate no longer exists. Based on the background above, the author formulates the main issues raised in this research. Undang-Undang Number 12 Tahun 2011, but if examined carefully, it will show a vacuum of norms and can also be said to be an obstacle in terms of testing of laws and regulations, if the law is contrary to the TAP MPR. After the 1945 Constitutional Amendment, the President is directly elected by the people and the President is responsible to the people and the President is subject to the Constitution made by the MPR, yes, but the President is no longer subject to the MPR as an institution but is subject to the product it makes, namely Undang-Undang Dasar 1945. The MPR is now equal in position with other constitutional institutions, namely the MPR is equal to the DPR, DPD, MK, MA, BPK, and also the President, and there is no longer higher and lower.
